5.1 Cancellation by the Participant
-
- The 50% deposit is non-refundable.
- If you cancel more than 30 days before the start of the camp, the remaining 50% will not be due.
- If you cancel 30 days or less before the start of the camp, the full amount of the camp is due. No refund will be granted, for any reason (including force majeure). We strongly advise participants to purchase travel cancellation insurance to protect against the risk of being unable to attend the camp.
However, your place is transferrable so you can find someone to take your place and you let us know by contacting us by email evoq.experience@gmail.com.
5.2 Cancellation by the Organizer
In the event that the retreat is canceled by the organizers due to unforeseen circumstances, participants will be eligible for a full refund.
5.3 Interruption of the Trip
In the event of early departure, no refund will be issued for any reason (including justified medical reasons). We strongly recommend that participants purchase cancellation and trip interruption insurance to cover the risks associated with an early departure, for any reason.
5.4 Weather Conditions and Activity Cancellations
Winter sports activities, including snowboarding, are subject to the inherent risks of variable weather and snow conditions, which may include, but are not limited to, wind, rain, insufficient snowfall, or any other conditions that make the planned activities impossible or unsafe. These risks are natural and predictable in a mountain environment.
If certain days or activities need to be canceled during the camp due to unfavorable or extraordinary weather conditions, no refunds, compensation, or indemnification will be granted.
The organizer commits to acting in good faith and will make reasonable efforts, where possible, to propose adjustments to the program or alternative activities. However, these alternatives, if provided, are not guaranteed to be equivalent in value or experience.
By agreeing to these Terms and Conditions, participants acknowledge that such circumstances fall outside the organizer’s responsibility and accept not to make any claims or take legal action on these grounds. Participants are also strongly encouraged to purchase specific insurance to cover such eventualities.
- Force Majeure Clause
In the case of force majeure, including but not limited to natural disasters, epidemics, strikes, or other events beyond the control of the parties, the organizer reserves the right to cancel or postpone the camp. Participants will then have the choice between a full refund or rescheduling at no additional cost.
- Cancellation Due to Insufficient Participants
The minimum number of participants required for the camp to take place is 14 people. If this number is not reached 30 days before the start date, the organizer reserves the right to cancel the camp. In this case, participants will be informed of the cancellation and will receive a full refund of the amounts already paid, without penalties. No other compensation may be claimed by participants in case of cancellation due to insufficient participants.
- Health Clause
In the event of a pandemic or epidemic, participants must comply with the health measures in effect at the time of the camp, as defined by the competent authorities. This may include providing a medical certificate or negative test result. Failure to comply with these measures may result in the participant’s exclusion from the camp without the right to a refund.
If participation becomes impossible due to justified health reasons (including mandatory quarantines or travel restrictions), no refund or rescheduling will be possible due to the unique nature of the camp. We strongly recommend that participants purchase cancellation and trip interruption insurance to protect against the risks related to cancellation for health reasons.
- Participant Behavior
Participants must respect the communal rules at Le Petit Baroudeur and follow the safety instructions given by the snowboard instructors. In the event of inappropriate or dangerous behavior, the organizer reserves the right to terminate the participant’s stay without a refund. The participant will be informed of their exclusion in writing or verbally and will have to leave the camp as soon as possible. The return travel costs will be at the participant’s expense.
- Use of Equipment
The snowboard equipment provided by the organizer is under the responsibility of the participant. Any intentional damage, loss, or serious accidental damage may result in repair or replacement costs charged to the participant. The equipment must be returned in good condition at the end of the camp.
- Respect for Diversity
The Winter Ride Camp is intended to be a safe, inclusive, and respectful space for all individuals, regardless of cultural background, gender identity, sexual orientation, or values. Each participant is expected to respect these fundamental principles of diversity.
Any discriminatory, oppressive, or persistent behavior, particularly related to sexuality, beliefs, or personal choices, will be considered inappropriate. The organizer reserves the right to issue a warning before taking any action of expulsion. In the case of particularly serious behavior, expulsion may be immediate and without refund.
- Travel and Insurance
Participants are responsible for their travel arrangements to and from Champéry, as well as for travel insurance covering health, accidents, and trip cancellations.
Participants are strongly advised to purchase liability insurance covering the risks associated with winter sports (including accidents, repatriation, etc.).
The organizer declines all responsibility in the event of an accident or incident occurring during activities supervised by external providers, even if these providers were appointed by the organizer. The responsibility for accidents, losses, or damages occurring during these activities lies with the providers themselves. The organizer also declines any responsibility for accidents occurring during unsupervised activities or activities independent of the services provided by the organizer.
In the event of non-compliance with safety instructions or dangerous behavior, the organizer reserves the right to exclude a participant without refund.
- Price and Services
The prices displayed are in CHF (Swiss Francs), including taxes, and include shared accommodation at the hostel (dormitory or twin), half-board (breakfast and dinner, excluding drinks), supervision of snowboarding activities, equipment rental, and other services provided in the program.
They do not include insurance or personal expenses.
- Modification of Services
The organizer reserves the right to modify the program for reasons beyond their control (weather, safety, etc.). The organizer commits to informing the participant of any major changes as soon as possible.
- Image Rights
Participants agree that photos and videos may be taken during the camp for communication and promotional purposes. These images may be used on any media (print, digital). If a participant does not wish to have their image used, they must inform the organizer in writing before the start of the camp at the email address evoq.experience@gmail.com.
- Confidentiality and Data Protection
The personal information provided by the participant during registration is treated confidentially and will only be used for the management of the camp. The organizer undertakes to comply with the applicable data protection laws, including the GDPR, to the extent it applies.
- Modification of the Terms and Conditions
The organizer reserves the right to modify these terms and conditions at any time. Registered participants will be informed of any modification of the terms and conditions by email at least 30 days before the new conditions take effect. The modifications will not apply to camps already booked.
- Mediation and Jurisdiction
In the event of a dispute, the parties agree to first resort to an independent mediator recognized by the Swiss authorities before any legal action. If no amicable solution is found, the competent court will be that of the Canton of Valais, Switzerland.
- Applicable Law
These terms and conditions are governed by Swiss law. Any dispute relating to their interpretation or execution will be submitted to the exclusive jurisdiction of the courts of the Canton of Valais, Switzerland.
